David A. Giordano

David Giordano focuses his practice on advising clients on strategies to protect all aspects of their intellectual property. David drafts and prosecutes patents across a wide variety of technologies including chemistry, medical devices, software, telecommunications, and mechanical devices. David represents a broad array of clients, including individual inventors, small and mid-size companies, universities, and large multinational corporations. As an IP Consultant to multiple clinical stage biopharmaceutical companies, David has filled the role of in-house IP counsel.

David also has extensive experience counseling clients. He has conducted due diligence analyses and provided freedom-to-operate and validity opinions for intellectual property matters pertaining to small molecules, pharmaceutical manufacturing processes, medical devices, antibodies, consumer products manufacturing processes, and semiconductor manufacturing processes. Additionally, David advises clients with regard to the strategic development of their patent portfolios and has successfully negotiated licenses on behalf of his clients.

David has substantial litigation experience that spans technologies from active pharmaceutical ingredients and medical devices to consumer products and mobile phone technologies. He has experience developing strategies relating to validity and infringement, as well as post-grant challenges. David’s litigation and post-grant experience allow him to counsel clients and prosecute patents with an awareness of the issues that could appear during litigation, resulting in prosecution and portfolio development strategies that increase the strength and value of a client’s intellectual property. Recent highlights include:

– Represented defendant in 9-day trial in the District Court of Massachusetts in a patent suit related to ceramics
— Obtained dismissal for lack of personal jurisdiction for declaratory judgment for non-infringement and invalidity filed in Northern District of California
— Achieved favorable settlement for patent owner engaged in multi-venue litigation
— Achieved a favorable settlement of alleged trademark infringement for a client against a large multinational conglomerate
– Successfully fended off meritless patent litigation threats pertaining to electronic securities auction technology against a client
– Represented an inventor in a contract dispute in Massachusetts Superior Court

David also worked with a premier litigation finance fund performing diligence on matters submitted for investment and on special patent projects. Over a span of 2½ years, David worked directly with the fund’s Managing Director of IP Investments reviewing matters and sourcing new investment opportunities.

David also counsels clients regarding trademarks and copyrights, including filing trademark applications and copyright registrations.

Prior to founding Giordano Law LLC, David practiced at Giordano & Chavous LLC for four years after practicing IP law at WilmerHale from 2004-2013.

Personal
David recently concluded a 5 year term on the Board of Directors for Performance-based Standards (PbS) Learning Institute, now the Center for Improving Youth Justice, a non-profit organization focused on improving juvenile justice outcomes for young people. David also recently concluded a term on the Board of Directors for ResearchILD, a non-profit organization that researches, develops, and distributes strategies for students with executive function challenges.

Locally, David is President and Director for Parkway in Motion, Inc., a non-­profit community organization serving the West Roxbury, Roslindale, and Hyde Park neighborhoods of Boston.

David lives in West Roxbury, Massachusetts with his wife and three children. He is an avid fitness enthusiast and loves to travel.
